Terms & Conditions – Gold4good (Promotion)

  1. Acceptance of Terms and Conditions

Instructions and information on how to enter the Promotion are set out in these terms and conditions. Submitting an entry into the Promotion is deemed as acceptance of these Terms and Conditions.

  • Promotion Period

The Promotion commences on Monday 1st June at 9.00 am AEST and closes on Tuesday 30th June 2020 at 2.00 pm AEST (Promotional Period).

  • Promoter

Fiona Elsey Cancer Research Institute ABN 151 08 331 657 (Promoter) Ballarat Technology Park Central Suite 23 106 -110 Lydiard St South Ballarat Vic 3350 is the promoter of the ‘Gold4good’ appeal and promotion.

Fiona Elsey Cancer Research Institute is working with AJL Fundraising Group ABN 72 757 913 379 (Consultant), to deliver the ‘Gold4good’ appeal and promotion.

  • Eligible Entrants

Entry is open to all Victorian residents aged 18 years or older (Eligible Entrant). The following persons are not eligible to enter:

  • the Promoter,
    • the Consultant,
    • the members of the management of the Promoter or Consultant,
    • employees of the Consultant or the Promoter,
    • any other person directly engaged in conducting the draw of the promotion, or
    • the spouses or any family members residing at the same address as any of the aforementioned persons.
  • How to enter

To enter, Eligible Entrants must either donate a piece of genuine gold or silver old, worn, broken or unwanted jewellery or an Australian gold coin (Eligible Donation) and post it to the Promoter via the supplied replied paid postage envelope or dropped to FECRI Institute reception by participants during the Promotional Period. Entry into the Prize Draw will only be given to Eligible Entrants that submit an Eligible Donation with the complete details requested on the envelope including their full name, address, telephone number and an acknowledgement that the person has read these Terms and Conditions.

There is no limit on entry per person.  Any entries submitted before or after the Promotional Period will not be accepted and will be deemed invalid.

Where the Eligible Entrant is donating jewellery in exchange for an entry into the Prize Draw, the Eligible Entrant warrants that they are the owner of or have the right to donate the jewellery. The Eligible Entrant understands that any donations cannot be returned.

  • Fundraising appeal

For every donation envelope received with (genuine jewellary items only) the Promoter will receive the greater of –

  • $20.00 or
  • 30% of total donations.

In the case of any currency or coins received via donation envelope the Promoter will receive 100% of cash donations. The donations described are collectively known as Net Donations. Within 30 days of the end of the Promotional Period the Net Donations will be transferred in cash into the Promoter’s nominated account.

  • Prize

The Consultant has donated a prize to the Promoter to support the Promotion.

The prize consists of a pair of 18 carat gold diamond earrings valued at $2,000 (Prize), which will be provided with a current written market valuation certificate. 

The Prize is not transferable, exchangeable, assignable to another person, redeemable for cash or for use in resale.

  • Prize draw

This is a game of chance. The winner will be selected at random on Thursday 2 July 2020 (Prize Draw Date) from the entry number allocated to each Eligible Entrant upon entry. The winner of the Prize will be notified within 2 days of the Prize Draw Date by telephone or mail. 

The winner’s full name may be published on the Promoter and/or the Consultant’s website or social media pages such as Facebook and Instagram. Eligible Entrants consent to their full names being published for the purposes of promoting the Promotion.

The Prize may be collected by the winner or will be delivered to the winner within 1 month of the Prize Draw Date, as agreed between the winner and the Promoter.

The Promoter will make all reasonable efforts to identify and locate the Prize winner. If the Prize winner is still unable to be located, the Promoter will keep the Prize for a period of 1 year from the Prize Draw Date. If the prize is not claimed within one year from the Prize Draw Date, the Promoter may apply the Prize or its sale proceeds to the purposes of Promoter’s organisation.

The Promoter will not be liable for any damage arising from the delivery of the Prize to the winner and delivery of the prize to the winner is at the risk of the winner from and including the time it leaves the possession and control of the Promoter and/or Consultant.

  • Validity of entries

The Promoter reserves the right, at any time, to verify the validity of an entry or disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. The decision to verify, validate or disqualify an entry or donation is at the absolute discretion of the Promoter.

The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, deletion, theft, destruction, transmissions interruption, communications failure or otherwise. The Promoter has no control over communications networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. In the event that an error with an entry occurs, the Promoter accepts no responsibility whatsoever for costs incurred, responses received or any other consequences.

The Promoter’s decision in relation to any aspect of the Promotion is final and no correspondence will be entered into.

  1. Liability

Neither the Promoter nor the Consultant will not be liable for items lost in transit or any loss or damage or personal injury suffered or sustained in relation to the promotion or the Prize except for any liability which cannot be excluded by law, in which case that liability is limited to the minimum extent.

Neither the Promoter nor the Consultant will not be held liable for theft or loss of goods in transit by other parties or services involved in campaign.

This promotion is in no way sponsored, endorsed, administered by or associated with Instagram or Facebook.

Eligible Entrants indemnify the Promoter, the Consultant and each of their related entities and agents from any loss, damage or expense arising from a breach of these Terms and Conditions by the Eligible Entrants.

  1. Force Majeure

If the Promoter and/or the Consultant is prevented from or delayed in performing an obligation by Force Majeure then the obligation is suspended during, but for no longer than, the period the Force Majeure continues and any further period that is reasonable in the circumstances. “Force Majeure” means an event beyond the reasonable control, which occurs without the fault or negligence of the Promoter and/or the Consultant.

  1. Delay or modification to conduct of the promotion

If the Promotion is interfered with in any way, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law

  • to disqualify any entrant; and/or
  • to modify, extend, suspend, terminate or cancel the promotion without prior notice, as appropriate.

Subject to obtaining the approval from the regulator (if required by law), the Promoter reserves the right to cancel, terminate, delay, modify or extend any aspect of this promotion, if for any reason it is not capable of running as planned (including without limitation, by reason of infection by computer virus, bugs, tampering, fraud, technical failures, power failures, legally binding directive to the Promoter to end any component of the promotion or due to any other causes unforeseen or beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion) but only to the extent necessary to overcome the issue that is affecting the running of the promotion as planned.

  1. Changes to Terms and Conditions

If the Promoter reasonably considers that a change to these Terms and Conditions is likely to:

  • benefit Eligible Entrants; or
  • be of no or immaterial detriment to Eligible Entrants,

then subject to obtaining approval from the regulator (if required by law), the Promoter reserves the right to make such changes and may place a notification on its website www.fecri.org.au

The Promoter may assign its rights under these Terms and Conditions to any third party at its discretion.

  1. Privacy

Personal information including each entrant’s name, address, telephone number and email will be collected and used for the purpose of conducting this Promotion.

By entering the Promotion, an Eligible Entrant consents to the Promoter and/or the Consultant accessing, collecting, using and disclosing their personal information to third parties, including local regulatory authorities and the Promoter and/or the Consultant’s agents or third party service providers, for the purposes of conducting the Promotion.

Eligible Entrants agree that the Promoter and the Consultant may use this information for the purpose/s of the Promotion.

If an Eligible Entrant does not provide the Promoter and/or the Consultant with the personal information requested, the Eligible Entrant cannot participate in the Promotion.
